Introduction

Welcome to the Academy of Veterinary Technicians in Diagnostic Imaging (AVTDI) Final Application System (app.avtdi.org). By accessing and using this application, you agree to be bound by these Terms and Conditions. Please read them carefully before using the application.

Data Ownership and Logging

All information transmitted or submitted through app.avtdi.org, including but not limited to application data, case logs, case reports, personal information, documents, and any other content, is the property of the Academy of Veterinary Technicians in Diagnostic Imaging (AVTDI).

All data transmitted through the application is logged and can be reviewed at any time by AVTDI representatives for purposes including but not limited to application review, quality assurance, compliance verification, and system administration. By using this application, you acknowledge and consent to such logging and review.

Acceptance of Terms

By accessing or using app.avtdi.org, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use this application.

Use of the Application

You agree to use the application only for lawful purposes and in accordance with these Terms and Conditions. You agree not to:

Use the application in any way that violates any applicable federal, state, local, or international law or regulation
Transmit any material that is defamatory, obscene, indecent, abusive, offensive, or harassing
Attempt to gain unauthorized access to any portion of the application or any related systems or networks
Interfere with or disrupt the application or servers or networks connected to the application
Use any automated means to access the application without express written permission

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify AVTDI immediately of any unauthorized use of your account or any other breach of security.

Intellectual Property

The application and its original content, features, and functionality are owned by AVTDI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the application without express written permission from AVTDI.

User Content and Submissions

You retain ownership of any content you submit through the application; however, by submitting content, you grant AVTDI a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any form, media, or technology now known or later developed.

You represent and warrant that you own or have the necessary rights, licenses, and permissions to submit the content and grant the rights described above. You agree that all content you submit is accurate, truthful, and not misleading.

Privacy

Your use of the application is also governed by our data ownership and logging policies as outlined above. AVTDI reserves the right to access, review, and use all data submitted through the application for legitimate business and administrative purposes. We are committed to protecting your privacy and handling your personal information in accordance with applicable privacy laws and regulations.

Termination

AVTDI reserves the right, in its sole discretion, to terminate or suspend your access to the application, with or without notice, for any reason, including but not limited to:

Violation of these Terms and Conditions
Fraudulent, abusive, or illegal activity
Request by law enforcement or other government agencies
Extended periods of inactivity
Discontinuation or material modification of the application

Upon termination, your right to use the application will immediately cease. All provisions of these Terms and Conditions that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Indemnification

You agree to defend, indemnify, and hold harmless AVTDI, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the application, your violation of these Terms and Conditions, or your violation of any rights of another party.

Disclaimer of Warranties

The application is provided on an "as is" and "as available" basis. AVTDI makes no representations or warranties of any kind, express or implied, regarding the operation or availability of the application or the information, content, or materials included on it. Without limiting the foregoing, AVTDI disclaims all warranties, express or implied, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the application will be uninterrupted, secure, or error-free
Warranties that defects will be corrected or that the application is free of viruses or other harmful components
Warranties regarding the accuracy, reliability, or currency of any information, content, or materials on the application

Limitation of Liability

To the fullest extent permitted by applicable law, AVTDI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the application.

In no event shall AVTDI's total liability to you for all damages, losses, or causes of action exceed the amount you have paid to AVTDI in the twelve (12) months prior to the action giving rise to liability, or one hundred dollars ($100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the United States for the resolution of any disputes arising out of or relating to these Terms and Conditions or your use of the application.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if such modification is not possible, severed from these Terms and Conditions. The remaining provisions shall remain in full force and effect.

Waiver

No waiver by AVTDI of any term or condition set forth in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of AVTDI to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms and Conditions, by operation of law or otherwise, without AVTDI's prior written consent. Any attempt by you to assign or transfer these Terms and Conditions without such consent will be null and void. AVTDI may freely assign or transfer these Terms and Conditions without restriction.

Force Majeure

AVTDI shall not be liable for any failure or delay in performance under these Terms and Conditions which results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Entire Agreement

These Terms and Conditions, together with any additional terms and conditions that may be posted on the application from time to time, constitute the entire agreement between you and AVTDI regarding your use of the application and supersede all prior and contemporaneous agreements, representations, and understandings between you and AVTDI.

Changes to Terms

AVTDI reserves the right to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the application after any changes constitutes acceptance of the new Terms and Conditions. If you do not agree to the new terms, you must stop using the application.
